Wigsuite INC – Terms and Conditions

Welcome to Wigsuite INC (“Wigsuite”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our SMS messaging platform (the “Service”). By creating an account, using the Service, or sending any SMS messages through our platform, you agree to these Terms. If you do not agree, please do not use the Service. By subscribing to SMS communications through an institution using the Wigsuite platform, you consent to receive text messages related to that institution, which may include notifications, event reminders, community announcements, and occasional marketing content. Message frequency may vary depending on the institution’s schedule and communication needs. Message and data rates may apply depending on your mobile carrier and plan. You may opt out of receiving SMS messages at any time by replying STOP. For assistance, you may reply HELP. Your privacy is important to us—please refer to our Privacy Policy for more information on how your data is handled.
Key Terms
1. Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement. By using the Service, you confirm you meet this requirement.
2. SMS Messaging & User Responsibilities
Wigsuite provides tools for users (“Clients”) to send SMS messages and broadcasts to subscribers. Clients are solely responsible for obtaining proper consent, providing opt-in mechanisms, including opt-out instructions, complying with laws (TCPA, CAN-SPAM, CTIA), and not sending spam, prohibited content, or purchasing phone numbers without consent.
3. Opt-In Requirements
All recipients must explicitly opt-in to receive SMS messages from you, via keyword, web form, or written/in-person consent. Proof of opt-in must be maintained.
Compliance and Data
4. Opt-Out Compliance
Every message must clearly explain how to opt out. When a user opts out by replying STOP, messages to that number must immediately cease. Wigsuite automatically tracks opt-outs for compliance.
5. Data Collection & Storage
We collect data necessary for the Service, including phone numbers, message content, message timestamps, and opt-in/opt-out statuses. We do not sell or share this data except as required for law or service provision.
6. Security
We take reasonable measures to protect data, but cannot guarantee complete security. Users must secure their login credentials and exported data.
Service & Legal
7. Service Availability
We strive for platform reliability but do not guarantee uninterrupted access. Suspension or platform modification may occur without notice. Delivery failures outside Wigsuite’s control are not our responsibility.
8. Fees
Use of Wigsuite may involve fees. You agree to pay all applicable fees as per our pricing and billing terms. Pricing may change with advance notice.
9. Termination
We may suspend or terminate your access if you violate these Terms or the law. Upon termination, your data may be deleted or made inaccessible.
Liability & Contact
10. Disclaimer of Warranties
Service is provided “as is” without warranties of any kind. Message delivery is not guaranteed due to factors beyond our control.
11. Limitation of Liability
Wigsuite INC is not liable for indirect, incidental, or consequential damages, including delivery failures or legal penalties from misuse of the platform.
12. Indemnification
You agree to indemnify, defend, and hold harmless Wigsuite INC from any claims, losses, or costs arising from your violation of the Telephone Consumer Protection Act (TCPA), including sending messages without proper consent.
13. Governing Law
These Terms are governed by the laws of the State of New York. Disputes will be resolved in New York courts.
14. Modifications
We may update these Terms at any time. Continued use after changes are posted constitutes acceptance.
